Minister of Health Juras Požela said he believes that vaccination is the right step to avoid sickness among children, but that the “court’s decision must unquestionably be followed.”
“They clearly said that the decree violates the constitution. We will have to follow the court’s order. However, I personally believe that vaccinating children is the right move to prevent diseases,” said Požela.
However, one of the initiators of the complaint against the decree – Labour Party Seimas member Dangutė Mikutienė, chairwoman of the Seimas Committee on Health Affairs, said she had a “very positive” view of the decision.
“Essentially, the court said that all three of the ministers’ decrees violated the constitution and that they also violate the principles of legal hierarchy, because any such regulations can only be set by laws. This is something for parents to decide, which is what the constitution and the Civil Code say,” said Mikutienė.
The decree to prevent unvaccinated children from attending kindergartens, which was passed by former Minister of Health Vytenis Povilas Andriukaitis, was to come into effect in September of this year.
