Vilnius Regional Court Judge Rasa Ragulskytė-Markovienė announced on Thursday the court had turned to the CJEU in this case, asking to rule on whether EU directives regulate mandatory provision of location data when calls are made from devices without SIM cards.
Until the CJEU ruling, the hearing of the compensation case is stopped.
The case is related to the death of a 17-year-old girl who was murdered on Sep. 21, 2013 in the town of Dembava, Panevėžys District, northern Lithuania. Two young men spotted her waiting for a bus and forced her into their care and later raped her. They then locked her in the car boot and burned her alive to hide the crime.
Locked in the car boot, the girl called the 112 emergency number ten times and spent an hour asking for help but never received it since neither the Vilnius nor Panavėžys emergency center were able to identify her location.
The two men were sentenced to life in prison.
