Last October, another court of the Lithuanian capital had restricted his freedom for the comment under an article for public approval of international crimes, crimes committed by the Soviets and Nazi Germany against the Republic of Lithuania or its residents, denial or gross humiliation.
“Thank you Stalin, Sniečkus and the Soviet administration. Those who do not like being with Russia – get lost from Lithuania, you can go to America,” Subotinas said in the 2016 comment under an article in an online portal.
However, Vilnius judge Laureta Ulbienė said on Thursday that the sentence was insufficient for applying criminal liability against the person.
“The sentence is too short to be able to decide whether his mind is set against Lithuania,” said the judge.
Furthermore, Ulbiene said that prosecutors had failed to establish that it was Subotinas who was the author if the comment, as the man did not have a smartphone or a computer.
The earlier verdict was that the man would have to be at his home between 10 p.m. and 5 a.m. every day for the next 14 months.
